IOGEAR Requests ITC Investigation Against Belkin, Emine, JustCom, and RATOC for Patent Infringement [11-13-2006]

Irvine, CA – November 13, 2006 - ATEN Technology Inc., which also operates as IOGEAR, and ATEN International, announced that it has submitted a complaint for patent infringement against Belkin Corp. and several other companies to the United States International Trade Commission at Washington D.C. (“ITC”) on November 6, 2006. The complaint alleges that certain switches of Belkin, Emine, JustCom, and RATOC infringe ATEN’s U.S. Patent No. 7,035,112, entitled “Automatic Switch” (“`112 Patent”). The proposed respondents include: Belkin Corp., Belkin Logistics, Inc., Emine Technology Co., Ltd., JustCom Tech, Inc., RATOC Systems, Inc., and RATOC Systems International, Inc. Among other restitution, ATEN requests that ITC issue an order to permanently exclude the accused switches and other infringing switches from entry into the United States, and orders to prohibit the sale and offer for sale of such products in the United States. The `112 patent relates to switches or KVM switches having cables attached thereto, such as IOGEAR`s MiniView Micro Series and ATEN’s Cable KVM Switches. The `112 patent gives ATEN the legal rights to exclude others from making, importing, selling, and offering for sale in the United States similar switches and other infringing switches. ATEN, which also operates in the United States as IOGEAR, intends to vigorously enforce its legal rights in the `112 patent and requests that sellers and resellers discontinue selling and promoting the devices that infringe the `112 patent.
